Through this criminal misc. application, constitutional jurisdiction has been invoked, whereby an order dated 09.02.2024, passed by the I-Additional Sessions Judge/Ex-Officio Justice of Peace, Larkana has been impugned, under which the directions were accorded to the S.H.O concerned to record the statement of the respondent No.3 and if cognizable offence is made out, lodge the F.I.R.

Learned counsel for the applicant submits that after passing of the order, parties have patched up outside the court. A recovery suit U/o 37 Rule 1 C.P.C filed by the complainant in the court of District Judge has also been withdrawn. He apprehends that since the parties have patched up and the impugned order in this criminal misc. application is in field, therefore, prays to set-aside the same.  

Since, the parties have patched, therefore, no purpose will be served, if impugned order remains in field. Accordingly, same stands set-aside and instant Criminal Misc. Application disposed of.
