Faisal Ellahi is present on interim pre-arrest bail
in FIR No.185 of 2023, registered at P.S. Ajmair Nagri, for offence under Section 406, PPC.
2. At the
very outset, Mr. Irfan Ahmed Memon,
advocate, files Vakalatnama as well as no objection on behalf of complainant
Muhammad Khalid Izhar, for the reasons that the
complainant and applicant/accused have settled their dispute outside the Court.
Complainant is present and confirms the contents of application for no
objection. In view of such position, learned Additional Prosecutor General
Sindh has recorded her no objection.
3. In view
of the statement of learned counsel for complainant and no objection of learned
Additional Prosecutor General Sindh, interim pre-arrest bail granted to
applicant/accused by this Court vide order dated 12.11.2024, is hereby
confirmed on the same terms and conditions. However, learned trial Court is
directed to decide the case of applicant/accused expeditiously, preferably
within a period of three months.
5. Needless,
to mention here that the observations made hereinabove are tentative in nature
and would not influence the trial Court while deciding the case on merits.
6. The
instant bail application is accordingly disposed of.
