Applicant/accused
Akhtar Ali son of Haji Naseeruddin,
seeks post arrest bail in FIR No.224/2024, registered at P.S. Baghdadi for
offence under sections 23(1)(a), 24, 25, 32 Sindh Arms Act, 2013. It is alleged
in the FIR that he possess a licensed pistol, which was used by his brother in
offence under section 302, PPC, arising out of FIR No.220/2024 of PS Baghdadi.
It is not alleged in FIR that applicant has used the weapon in the commission
of offence but the only allegation against him is that his brother has used the
same. Counsel for applicant/accused submits that the applicant is in custody
since 28.08.2024; case has been challaned and
applicant is no more required for further investigation.
Learned
Additional Prosecutor General Sindh submits that applicant/accused is not
involved in any other case, except the present case.
Having
heard the learned counsel for parties and perused the material available on record.
Prima facie, it appears that
sufficient grounds are available to make out a case of further inquiry. As
such, applicant/accused Akhtar Ali son of Haji Naseeruddin is admitted to post arrest bail in the foresaid
FIR, subject to his furnishing solvent surety in the sum of Rs.100,000/- (Rupees one
lac) and P.R. Bond in the like amount to the satisfaction of trial Court. However,
it is made clear that the above observations are tentative in nature, the same would not be prejudice the case of either
party at trial.
The
instant criminal bail application is disposed of in the above terms.
