Grievance of the applicants is that they were nominated in the case and after investigation were declared innocent. However, VI-Civil Judge and Judicial Magistrate, Shikarpur took cognizance and issued bailable warrants against the applicants on 29.06.2024.

Learned counsel for the applicants submits that once the applicants went to the learned Magistrate in compliance of the bailable warrants, for the reasons best known to the learned Magistrate, he declined to record their appearance in court and instead issued N.B.Ws against them. He submits that applicants are willing to surrender themselves before the learned trial court, however apprehends that they will be arrested due to the issuance of N.B.Ws.

I have heard the learned counsel for the applicants and learned Deputy Prosecutor General, Sindh.

As the applicants intend to surrender themselves before the trial court to face the trial, it would be appropriate if the operation of N.B.Ws is suspended for a period of two weeks, so that they can appear before the learned trial court in compliance of the order dated 29.06.2024. Application is disposed of in the above terms.
