Appellant
and his counsel are called absent. On the last date of hearing viz. 02.11.2021,
following order was passed:
“This
is an appeal against acquittal, which has not yet been admitted to regular
hearing. Learned counsel for the appellant has indicated that there was an
eyewitness of this case, however, the deposition has not been placed on record
before this Court. Prior to the next date of hearing, learned counsel for the
appellant shall ensure the legible copies of all evidence recorded before the
learned trial Court is placed on record so that he may go through the same and
point out any legal infirmities in the impugned judgment based on the evidence
which would justify the admission to regular hearing of this appeal against
acquittal.”
The name of the counsel for the appellant transpires in
the cause list. Apparently, the appellant is no more interested to pursue the
instant appeal, which is dismissed for non-prosecution.
