Through this Cr. Misc. Application,
applicant/accused Muhammad Umair son of Sardar Ali seeks reduction in the
surety amount from Rs.1,000,000/- to Rs.100,000/-.
Concise facts leading to filing of the instant
application are that bail was granted to applicant/accused Muhammad Umair by
learned Presiding Officer, Special Court (Offences in Banks) Sindh at Karachi,
vide order dated 28.2.2013 in the sum of Rs.1,000,000/- and PR bond in the like
amount. Applicant/accused Muhammad Umair moved an application before the trial
Court for reduction of the surety amount but his request was declined.
Learned advocate for applicant/accused mainly
contended that bail has been granted to the applicant/accused on 28.2.2013 but
applicant/accused could not furnish the surety and he is behind the bars.
Learned DAG recorded his no objection if surety amount is reduced to some
reasonable extent.
Keeping in view the circumstance that bail has
been granted to the applicant/accused Muhammad Umair on 28.2.2013 and he has
failed to furnish the surety, therefore, on humanitarian grounds surety amount
is reduced from Rs.1,000,000/- to Rs.500,000/- and PR bond in the like amount
to the satisfaction of the trial Court. The impugned order is modified to the
above extent and Cr. Misc. Application is accordingly disposed of.
