1. Urgent application is allowed.

2. Instant Criminal Miscellaneous Application is filed by applicant Muhammad Ehsan against the order dated 22.09.2015 passed by learned Special Court (Offences in Banks) Sindh at Karachi, whereby bail was granted to the applicant Muhammad Ehsan subject to his deposit non-refundable amount of Rs.3,00,86,400/-. It was further ordered that Muhammad Ehsan shall be released on bail subject to furnishing solvent surety in the sum of Rs.50,00,000/- and P.R bond in the like amount to the satisfaction of the Trial Court. Applicant being dissatisfied with the surety amount has filed application under Section 561-A Cr.P.C.

Learned Advocate for the applicant submits that he would not press the Criminal Miscellaneous Application in case applicant is permitted to repeat application before the Trial Court for reduction of the surety amount, as according to the learned counsel for the applicant there is fresh ground as co-accused Azhar Ali Khawaja and Saeed Ahmed Qazi have been granted bail in the same crime by this Court in Criminal Bail Application No.1278/2014 in the sum of Rs.2 Million each and P.R. bond in the like amount.

Learned DAG recorded no objection.

In view of statement of learned counsel for the applicant, Criminal Miscellaneous Application is dismissed as not pressed. Applicant would be at liberty to file application before the Trial Court for reduction of the surety in the light of the order passed by this Court in Criminal Bail Application No. 1278/2014. After filing of the application by applicant for reduction of surety, Trial Court shall decide the same within 15 days in accordance with law.
