This is an application for return of
surety. It appears that protective/transitory bail was granted to accused Asad
Khan by this Court vide order dated 19.07.2022 in the sum of Rs.100,000/- and
P.R bond in the like amount. Surety was furnished by Shoaib Khan son of
Muhammad Younus by depositing Defence Saving Certificates. It is stated that
accused Asad Khan joined the trial and vide judgment dated 10.10.2022, he has
been acquitted by learned Special Judge (Central-II) Karachi. Copy of the
judgment dated 10.10.2022 is annexed along with the application of return of
surety.
DAG
recorded no objection for return of surety.
In
the view of above, application for return of surety is allowed. Nazir is
directed to return the Defence Saving Certificates as well as profit, if any,
to the surety, after proper verification and identification as per Rules.
