This Constitution petition is filed by
the petitioners against the respondents. Petitioners have prayed for the
following reliefs:
i.
That this
Honourable Court may be pleased to call the official & private Respondents
and direct them strictly not to harass the Petitioners and family members in
any manner without adopting due process of law.
ii.
Further direct Official
Respondent No.4 that they shall not misuse their official powers and position
at the instance of Respondent No.4 by harassing the Petitioners in any manner.
iii.
That necessary
action should be initiated against the official Respondents for maltreating,
humiliating and act of illegally dispossessing the petitioners from his
property and directions may also give to the Respondent No.4 not lodge the FIR
against the petitioners.
iv.
That any other
relief(s) this Honourable Court may deem fit and proper under the
circumstances.
Notice
was issued against the respondents as well as A.G. Respondent No.4 was directed
to file specific comments. Respondent No.4 has filed the comments in which it
is mentioned that an application was submitted before him by Usama, the respondent
No.1 with regard to property dispute and legal proceedings under Section 145
Cr.P.C have been initiated by II-Civil Judge/ Judicial Magistrate, Karachi
East. So far allegation of harassment is concerned, the same has been denied by
the Respondents. Police officials present in Court also deny the allegation of
harassment. AAG as well as APG undertake that official Respondents shall act
strictly in accordance with law.
In
the view of above counsel for the petitioners expressed his satisfaction and does
not press the petition any more, it is accordingly disposed of.
