CMA No. 3685/2023 is moved by the
counsel for the appellant for return of surety amount under Section 151 CPC.
Notice was issued to the respondent and
report was called from Nazir. It appears that respondent No.1 appeared on the
last date of hearing and recorded no objection for return of security amount.
Nazir in his report has submitted that in
compliance of Court order dated 14.03.2023, appellant had deposited
Rs.165,000/- as security in compliance of the Court order dated 03.09.2020,
which is lying in his office. Counsel for the appellant submits that II-Appeal
No. 222 of 2019 has been disposed of vide order dated 14.03.2023.
Since AAG as well as respondent No.1
recorded no objection, application for return of security amount is allowed. Nazir
is directed to return the security amount to the appellant, after proper
verification and identification as per Rules.
