This is an application for return of
surety. It appears that Interim pre-arrest bail was granted to accused Mazhar
Iqbal by this Court vide order dated 01.02.2024, subject to his furnishing
solvent surety in the sum of Rs.200,000/- and P.R bond in the like amount. Surety
was furnished by Husban Mazhar son of Mazhar Iqbal by depositing cash amount of
Rs.150,000/- along with Defence Saving Certificate of Rs.50,000/-. Thereafter,
vide order dated 02.07.2024, application for pre-arrest bail was allowed to
accused Mazhar Iqbal in the same terms vide order dated 01.02.2024 with an
additional surety amount of Rs.300,000/- to be furnished by accused with the
Nazir of this Court. Again surety was furnished by Husban Mazhar son Mazhar
Iqbal by depositing cash amount. It is stated that accused joined the trial and
vide judgment dated 11.11.2024, he has been acquitted
by learned XI-Civil Judge and Judicial Magistrate Karachi South. Copy of the
judgment dated 11.11.2024 is annexed along with the application of return of
surety.

P.G recorded no objection for return of surety.
In
the view of above, application for return of surety is allowed. Nazir is
directed to return the cash amount and Defence Saving Certificate as well as
profit, if any, to the surety, after proper verification and identification as
per Rules.
