IN THE HIGH COURT OF SINDH
AT LARKANA
Present:
Shamsuddin Abbasi, J.
Agha Faisal, J.
C.P D-265 of 2024 : Sher Baig Khan vs.
The Accountant General, Sindh and others.
For the Petitioner : Mr. Nasrullah Solangi, Advocate
Date of hearing : 30.04.2024
Date of Order : 30.04.2024
ORDER
Agha Faisal, J. The petitioner seeks to agitate a claim of salary with effect from 2005. At the very outset, the learned counsel was confronted with the issue of laches and he remained unable to satisfy the Court in such regard.
The petitioner also seeks relief against private respondents and the same could not be articulated to befall within qualification of Article 199 of the Constitution.
Prayer clauses also seek inquiry and registration of FIRs, however, no case could be articulated for direct recourse to writ jurisdiction in the presence of adequate remedy having been provided under the law.[1]
In view hereof, this petition is found to be misconceived, hence, dismissed. While this is a fit case for imposition of costs upon the petitioner, for having preferred this misconceived petition, a lenient view is taken and the imposition is eschewed.
