ORDER

 

Muhammad Saleem Jessar, J-.  Through captioned applications, applicant Abdul Jabbar Dayo (accused) seeks transfer of Special Case Nos. 44, 45, 47, 48, 49, 50, 51, 53, 82, 84 and 85 of 2019 from Camp Court (Kashmore @ Kandhkot) of Special Judge, Anti-Corruption (Provincial), Larkana, to its headquarter at Larkana, on the ground that the applicant and his relatives have been receiving threats from the notorious dacoits of the area for his abduction. The applicant has further mentioned that, in the past he was also abducted by the dacoits and after two months of his abduction he was released by Ratodero police after an encounter with dacoits and such F.I.R was registered at P.S Ratodero. He has placed on the record a photocopy of the F.I.R.  

 

            Heard learned counsel for the applicant as well as learned D.P.G., appearing for the State and perused the comments/ report furnished by the learned trial Court.

 

            Perusal of the comments / report of learned trial Court reflect that, these cases pertain to District Jacobabad, as such in view of the Notification No. Gaz/ Anti-Corruption (P) Camp Court dated 17.5.2023; the trial of the cases is being conducted at Camp Court Kashmore @ Kandhkot. The learned trial Judge has however extended no objection for transfer of the cases from Camp Court to Larkana headquarter. Learned D.P.G. in view of comments and the grounds urged in the applications also extended no objection.

 

            The apprehension shown by the applicant seems to be reasonable. Even otherwise, transfer of the cases from Camp Court to headquarter will not tend any inconvenience to any party; rather it would be in the fitness of things. Accordingly, trial of the aforesaid cases is directed to be conducted at headquarter of Court of Anti-corruption (Provincial), Larkana at Larkana. These applications stand allowed in above terms. Office to place copy of this order in all connected files.
