ORDER
Muhammad Saleem Jessar, J- Applicant Khan Muhammad son of Daim Khan Gadehi through application in hands has applied for post arrest bail, after his similar plea was declined by Court below vide Order dated 03.5.2023. He has been booked in F.I.R No. 112 of 2021 registered with P.S K.N. Shah for offences punishable under Sections 302, 324, 337-A (i), 337-F (i), 147, 148 & 149 P.P.C.
At the very outset learned counsel for applicant submitted that co-accused Abdul Hameed has been granted bail by this Court vide Order dated 21.08.2023 in Crl. Bail Appln. No. S- 324 of 2023. Learned counsel has already placed on record certified true copy of such order. Per learned counsel, the case of the applicant is on same footings to that of co-accused, who has been granted bail by this Court. Per learned counsel, the applicant, on the basis of rule of consistency, also deserves same concession and treatment.
Learned D.P.G. appearing for the State, in view above position, raised no objection to grant of bail to the applicant.
Since, co-accused Abdul Hameed has been admitted to bail by this Court and case of present applicant appears to be mostly on same footings, therefore, rule of consistency or parity is applicable to his case and he also deserves the same concession and treatment to be meted out.
Accordingly, in view of the above circumstances, the bail application in hands stands allowed. Applicant Khan Muhammad is granted bail upon his furnishing a solvent surety each in the sum of Rs.300,000/- (Three hundred thousand rupees) and P.R bond in the like amount to the satisfaction of trial Court.
