ORDER

Muhammad Saleem Jessar, J: Through this application, applicant Khadim alias Basar son of Haji Khan by caste Shar has sought for his admission to post-arrest bail in Crime No.61 of 2021, registered at Police Station New Foujdari (Shikarpur), for offenses punishable under Sections 302, 324, 148, 149, 114 and 337-H (2) P.P.C. His similar request was turned down by learned 1^st Additional Sessions Judge, Shikarpur, vide his Order dated 27.6.2023.

2.         This bail application has been pressed by the learned counsels for the applicant mainly on medical ground of ailment of the applicant, as according to them, the applicant has been suffering from kidney and liver ailments since long and his remaining in jail would be detrimental to his health and life.

3.         Vide order dated 27.11.2023 this Court directed Senior Superintendent of District Prison, Shikarpur, to get the applicant examined from concerned doctor and submit such report before this Court. As such, the applicant was medically examined and treated from RBUT Civil Hospital, Shikarpur, by jail authorities. On 01.01.2024 the Jail-Superintendent furnished the report to the effect that applicant was referred to aforesaid hospital on 02.11.2023 for medical examination and treatment and then for follow-up applicant was again referred to hospital on 09.12.2023, 11.12.2023 and the doctors have opined that the applicant is vitally stable.   

4.         Since, the doctors have opined that the applicant is vitally stable; as such his remaining in jail would not be hazardous and detrimental to his life. Therefore, the ground of ailment taken by the applicant does not exist anymore. Accordingly, the bail application stands dismissed. However, the learned trial Court is directed to expedite the trial and ensure its early conclusion within shortest possible time under intimation to this Court through Additional Registrar.
