O R D E R.

 

                    Appellant Husain Shah alias Raja Shah son of Abdul Rasool Shah was charged and tried by the learned Additional Sessions Judge, Ratodero, in Sessions Case No.748/2018 re-The State V. Hussain Shah @ Raja Shah & others, based upon F.I.R No.61/2018 of P.S Naudero, and on conclusion of trial he was convicted and awarded multiple sentences. The appellant has filed instant criminal appeal before this Court against the judgment of his conviction.

 

                   Mr. Habibullah G. Ghouri, learned Counsel for the appellant, submits applications u/s 345(5) and 345(6), Cr.P.C and submits that the appellant and complainant Karam Ali Shah @ Minal Shah, who is the only injured in this case, have entered into compromise on the intervention of their nekmards. Both parties i.e. the appellant Hussain Shah @ Raja Shah and injured/complainant Karam Ali Shah alias Minal Shah being present in Court jointly request for according permission to them to compound offence and for acquitting the appellant/accused by accepting such compromise.  Office to assign proper number to these applications.

 

                   Complainant/injured Karam Ali Shah @ Minal Shah state that he has entered into compromise with the appellant on the intervention of their nekmards, hence he has forgiven him and do not claim any compensation, Arsh or Daman etc. He has also stated that he has no objection if the appellant is acquitted of the charge in terms of compromise. 

 

                   In view of above position, permission under Section 345(5), Cr.P.C. to compound the offence is accorded to the parties. As a result whereof, the compromise between the parties is accepted and the appellant is acquitted under Section 345(6), Cr.P.C. He is present on bail. His bail bonds stand cancelled and surety discharged.

 

                   Instant criminal appeal is disposed of in terms of compromise.
