ORDER

Muhammad Saleem Jessar, J: Through this bail application, applicant Saddam Hussain son of  Abdul Razaque Mirani seeks post arrest bail in a case registered against him vide Crime No. 235 of 2023 at P.S Kashmore under Section 23 (1)(a) of the Sindh Arms Act, 2013.

            2.         The allegation against the applicant is that, an unlicensed pistol alongwith four live bullets of 30-bore was recovered from his possession, which was allegedly used by him in the commission of offence, viz. Crime No.217/2023 of P.S Kashmore, under Sections 353, 324, 401, 34 P.P.C.

            3.         It is the case of the prosecution that the applicant was arrested alongwith pistol, which was allegedly used by him in aforesaid case i.e. Crime No.217 of 2023 of P.S Kashmore. The bail to applicant in aforesaid F.I.R/ case has been granted by this Court today on the ground of further enquiry. As such, in the existing circumstances the same ground of further enquiry is available to the applicant in this case also, therefore, it will be fair and proper that he may be released on bail in this off-shoot case.

            4.         For these reasons the applicant was granted bail vide short order dated 26.01.2024 upon his furnishing a solvent surety in the sum of Rs.50,000/- (Fifty thousand rupees) and P.R bond in the like amount to the satisfaction of trial Court and these are reasons for the short order.
