4.        It is contended by learned counsel for the applicant that based on an honest investigation, the applicant was let off by the police by placing his name in column No.2 of the charge sheet; he has been joined in trial by learned trial Magistrate without lawful justification, which order is impugned by him before this Court by way of instant Cr.Misc.Application and he would not press the same, if the applicant is permitted to seek his premature acquittal by filing such application before learned trial Court, per law.

            Under the discussed circumstances, the instant Cr.Misc.Application is dismissed as not pressed with direction to the learned trial Court to dispose of the application, if it is preferred by the applicant for his premature acquittal, within one month of its filing.
            Order accordingly.
