It is contended by learned counsel for the applicants that based on very fair investigation, the applicants were let off by the police by placing their names in column No.2 of the charge sheet; they have been joined in trial by learned trial Magistrate without lawful justification, which order is impugned by them before this Court by way of instant Cr.Misc.Application and he would not press the same provided the applicants are permitted to seek their premature acquittal by filing such application before learned trial Court, per law.

            Under the discussed circumstances, the instant Cr.Misc.Application is dismissed as not pressed with direction to the learned trial Court to dispose of the application, if it is preferred by the applicants for their premature acquittal, within one month of its filing.
            Order accordingly.
