IRSHAD ALI SHAH, J.- It is alleged that the applicant with the rest of the culprits, after having formed an unlawful assembly and in the prosecution of its common object, caused fireshot injuries to complainant Ajab Din and PW Mouj Ali, intending to commit their murder, for which the present case was registered.

2.        The applicant having been refused post-arrest bail by learned Additional Sessions Judge, Kamshore, has sought the same from this Court by way of instant application u/s. 497 Cr. PC.

3.        Heard arguments and perused the record.

4.        The FIR of the incident has been lodged with a delay of about three days; such delay having not been explained plausibly could not be overlooked. No active role in the commission of the incident has been attributed to the applicant. The parties are already disputed over the landed property. The case has finally been challaned. In these circumstances, a case for the release of the applicant on bail on the point of further inquiry is made.

5.        Under the discussed circumstances, the applicant is admitted to bail subject to his furnishing surety in the sum of Rs.50,000/- and P.R bond in the like amount to the satisfaction of the learned trial Court. 

6.        The instant bail application is disposed of accordingly.
