                        It is inter alia contended by the learned counsel for the applicants that after obtaining pre arrest bail, the applicants had joined the investigation and subsequently their interim pre arrest bail was confirmed by Ist Additional Sessions Judge, Hyderabad vide order dated 08.04.2008. Later on challan was submitted before the concerned court but neither any notice was issued to the applicants nor they were informed about submission of challan and they remained absent. It is further contended that absence of the applicants was neither willful nor deliberate but they were unaware about the submission of challan.

Learned State counsel very frankly concedes the above position.

In view of the above, the NBWs against applicants and notice to their surety issued by the trial court stand set-aside. The applicants are directed to attend the trial court.

The Criminal Revision Application No.S-136/2009 stands disposed of.
