The petitioner assails the averred criminal lack of medical care in District Larkana in Government hospitals as being repugnant inter alia to the right to life enshrined in the Constitution. It is highlighted that the Government appears unconcerned with the prevailing strike by Government doctors and paramedics at Government hospitals; including those under administrative control of CMCH and SMBBMU, Larkana. Learned counsel submits that the negligence and inaction on the part of the executive is prima facie violative of Articles 9, 14 and 25 of the Constitution of Islamic Republic of Pakistan, 1973.
Issue notice to the respondents, as well as the office of learned Advocate General and the Additional Advocate General Larkana, for 21.5.2024. The official respondents shall depute a senior officer to be present in Court along with the comments, copy whereof shall be provided to the petitioner’s counsel in advance.
Insofar, the issue of strike by Government doctors and paramedics working in government hospitals is concerned, the learned Additional Advocate General Larkana shall file the response of the worthy Chief Secretary Sindh in such regard and the said response shall include as to whether the Government has invoked the provisions of West Pakistan Essential Services (Maintenance) Act 1958, as amended by West Pakistan Essential Services (Maintenance) Sindh (Amendment) Act, 1973.
The office is instructed to communicate this order immediately to all concerned.
