At the very outset learned counsel for the appellant states that he does not press this appeal but would be satisfied if the conviction awarded to the appellants be converted into the period as already undergone.
Learned Assistant Prosecutor General Sindh for the State very frankly concedes the above request of the learned counsel for the appellants.
The appellants are first offenders and their Jail Roll reveals that they have already undergone a major portion of their sentence. They are said to be the lone bread earner of their respective families. Keeping in view the above facts and the period which the appellants have already undergone, the appeal is dismissed and the conviction and sentence of seven years and fine of Rs.25000/- is converted into the sentence as already undergone by the appellants.
With these observations appeal is dismissed. Jail Authorities are directed to release the appellants forthwith if not required in any other case.
