C.P.No.D-411 of 2023

1.    For orders on Office Objections at "A".

2.    For hearing of main case.

------

01.08.2023

Mr. Ali Raza Pathan, advocate for the petitioners a/w petitioners.

Mr. Liaquat Ali Shar, Additional Advocate General, Sindh a/w Inspector Ayaz Ahmed Pathan, ASI Muhammad Nawaz, P.S. New Foujdari, Shikarpur.

------

Through instant petition, petitioners Mst. Hina and Asif Ali have sought for providing legal protection to them and quashment of F.I.R No.31/2023 registered with Police Station A-Section Thull, for offences punishable under Sections 452, 365-B P.P.C, WPA, 3TIP, 2018.

Learned counsel for the petitioners submits that petitioner No.1 (Hina) has entered into freewill marriage with petitioner No.2 (Asif Ali), which annoyed the father of petitioner No.1, namely Karim Bux Noonari, who has registered aforesaid F.I.R against petitioner No.2 and others. Per learned counsel, the F.I.R in question is nothing but bundle of lies and it has been registered just to put the petitioners in troubles and hardships.

Pursuant to notice, the investigating officer of the case/ F.I.R has put his appearance and submitted that the investigation of the case is under process. On directions of this Court the I.O recorded statement of petitioner No.1 (Hina), the alleged abductee and placed on record copy of such statement. In her statement, petitioner No.1 Hina has stated that she has entered into freewill marriage with petitioner No.2 Asif Ali and she has never been abducted by anybody.

The petitioner No.1 (alleged abductee/ victim) has negated the contents of the F.I.R registered for her abduction by her father.  In these circumstances, prima-facie no offence as alleged in F.I.R in question seems to have taken place.  As such, the investigating officer of the case is directed to file final/ supplementary report/ challan of the case to the concerned Court in light of statement of Mst. Hina recorded today for further orders in accordance with law.

The petition stands disposed of in above terms.
