exceptions.
3. The
petitioner has preferred this Petition under Article 199 of the Constitution,
praying that this Court be pleased:-
(a) “To
direct the respondents to ensure that all the NITs should be procured by way of
E-bidding (Electronic Bidding) so that the petitioner/contractor can save him
from the culture of pick and choose and payment percentage for NITs.
(b) To
direct the respondents that the fee for NIT shall be charged 20 percent from
the contractors instead of 30 percent so that more contractors can participate
in the NITs.
(c) To
direct the respondents that the submission of forms shall be proceeded through
online system so that contractors do not face the problem of standing in lines
and pay bribe for clearance of their form.
(d) To
direct the respondent to monitor the bidding process under the surveillance of
cameras or other latest technology, so that, it will be beneficial for a
contractor can appeal for his right with evidence against the violation of
SPPRA rules.
(e) To
grant any other relief, which deems fit and proper under the circumstances of
the case.
(f)
To award the cost of suit.”
Having considered the matter, we are
of the view that the same does not present a fit case for issuance of a writ.Indeed,
the measures sought fall within the domain of the Executive or Legislature, as
the case may be. The petition thus stands dismissed in limine.
