Compliance
report has been submitted on behalf of the respondent No. 4, which reads as
under:-
“In
compliance with the order of Honourable High Court of Sindh Bench at Sukkur on
14.11.2023, regarding payment of pensionary benefits in favour of Mr. Khalid
HussainMangi, (petitioner). It is submitted that the Encashment amount to Rs.
960,000/- has already been paid, now the GPF amount to Rs. 803,288/- vie
chequeNo. GP009571 dated 15.11.20213 has also been paid to the petitioner as
per priority list, deposited in his bank Account No.0065-3053741055 maintained
at National Bank of Pakistan, Sukkur. The Divisional Accounts Office is
sub-office working under administrative control of Headquarters office,
Pakistan Railways, Lahore and act in the capacity of disbursing agency. The
undersigned is not a competent authority to make payment until and unless
budget allocated and directed by Headquarter Office Pakistan Railways Lahore.
Therefore, the undersigned has approached to the Headquarter Office Lahore vide
this office letter No. 3300-S/Pen/Suk/19996 dated 21.11.21023 for provision of
payment of commutation Rs. 2,886,690/- falls at Sr. 513 in the priority list,
in compliance of the orders of Honourable High Court of Sindh Bench at Sukkur.
The payment of gratuity/commutation will be paid to the petitioner as soon as
the budget allocated is received from headquarter office Lahore.”
Learned
counsel for the petitioner invites attention to the order dated 28.02.2023 made
by a learned Division Bench of this Court in CP No.D-1334/22 and connected
cases wherein certain directions were issued under analogous circumstances for settlement
of pensionary benefits.The operative part of that order reads as follows:-
“Accordingly,
Member Finance Department shall pursue summary and Secretary Finance Department
shall ensure that amount is released after completing all codal formalities and
Railway Authorities shall ensure that amount referred above, if released shall
be utilized for the pensionary benefits of the petitioners. This exercise shall
be completed within three (03) months.”
Learned
counsel for the Petitioner seeks that the petition be disposed of in similar
terms. Under the circumstances, the petition stands disposed ofwith the respondents
being directed to treat and process the case of the Petitioner in the aforesaid
terms.
