On 31.10.2023, following order was passed:-

Learned counsel submits that the petitioner is employee of Education Department and is civil servant; however, was promoted after considering his past record. Suddenly Director Schools Education (ES&HS), Larkana had issued letter dated 23.10.2023 (impugned order) withdrawing all the single page orders pertaining to the promotion of the employees. He; however, could not pin point his name mentioned under the impugned order, but is of the view that issue with regard to the promotion of employee may not be considered by the Sindh Services Tribunal, hence has maintained this petition.

Learned counsel is put on notice to satisfy the Court how this petition in view of above factual controversy is maintainable Meanwhile, notice be issued to learned Addl. A.G Sindh who shall assist the Court on the next date of hearing. To come up on 14.11.2023.

Again on 14.11.2023, learned counsel sought time to have instructions and then it was adjourned for today viz. 28.11.2023. Learned counsel for the petitioner submits that he has submitted an application before the Director Schools Education Larkana on 15.11.2023 and copy of the same has already been placed on record before the court through his statement dated 21.11.2023. Record supports his contentions. He, therefore, submits that petitioner will be satisfied if the respondent No.3 may be directed to entertain the application submitted by the petitioner by holding departmental promotion committee meeting (D.P.C) and if case of petitioner merits consideration then decide its fate according to the policy and rules framed by the government. Learned A.A.G. has no objection. Order accordingly.

Copy of order shall be sent to the respondent No.3 by fax today for compliance with directions to decide the said application within three months' time with compliance report to this court through Additional Registrar.
