            Mr. Mohammad Asif Zai advocate along with Petitioner

 

Mr. Allah Bachayo Soomro, Addl.A.G along with Mr. Safdar Ali Shah D.G (P.R) Department of Information and Archives Sindh.

 

We have heard the D.G. According to him there are serious complaints against the Petitioners’ behaviour and he has attempted to improve his conduct with officers and staff. The D.G states that for this reason the departmental proceedings were not initiated against the Petitioner. He further states that the transfer orders of the Petitioner were made within attempt to give opportunity to the Petitioner to improve instead of terminating his services. The Petitioner states that till date he has not been served with any show-cause notice reflecting that he has either disobeyed his superiors or ever shown disrespect to them. The D.G on the other hand states that the personal file of the Petitioner was full of explanations. We will not travel into this controversy. The Petitioner if behaves in the manner which falls within the definition of ‘misconduct’ the department would be at liberty to take action against him in accordance with law but the transfer of the Petitioner in the manner is not justifiable. However, the monthly salary of the Petitioner be disbursed.

            With the above observation we dismiss this petition in limine.
