The petitioners have invoked the jurisdiction of this Court under Article 199 of the Constitution, alleging that the Respondent No.5 lacks jurisdiction to proceed with an appeal preferred by the Respondent No.7 under Section 161 of Sindh Land Revenue Act, 1967. They seek that a declaration be made in that regard. Having considered the matter, we are of the view that the petitioners ought to appear and take such plea firstly before the Respondent No.5, so as to then avail the further remedies that would potentially arise in the event of any decision being rendered against them. The Petition stands disposed in such terms.
