DR. RANA MUHAMMAD SHAMIM, J. The applicant has assailed the impugned order of the learned trial court dated 06.12.2007 whereby the bail was refused to the applicant.

 

2.          Brief facts of the case are that accused Adam Khan Dharejo who was in custody, submitted deh Form VII along with an affidavit before the learned IIIrd Additional Sessions Judge, Sukkur for standing surety for accused Muhammad Anwar Dharejo in Sessions case No.182/2001 under Section 302 PPC. Verification report was called from the Mukhtiarkar, Pano Akil which received on 31.10.2007. The complainant/reader of the court suspected the documents as false and the concerned Mukhtiarkar was called personally to verify the documents who confirmed the documents as forged and consequently the F.I.R was lodged.

 

3.          Learned counsel for the applicant submits that the applicant is a Tapedar and has been involved falsely in this case on the statement of accused Adam Khan; that in the investigation the applicant, Assistant Mukhtiarkar, Pano Akil and the dispatch clerk had clearly stated that the documents submitted by accused Adam Khan Dharejo had not been submitted from their office.

 

4.          Learned State counsel states that since the applicant is a Government servant and has not misused the bail, he has no objection to the confirmation of his interim pre-arrest bail.

 

5.          I have heard learned counsel for the applicant, learned State counsel and gone through the material available on the record. In view of the no objection raised by the learned State counsel for confirmation of bail, the learned counsel for the applicant has succeeded to make out the case of the applicant for confirmation of the interim pre-arrest bail. Accordingly, interim pre-arrest bail granted to the applicant is hereby confirmed on same terms and conditions.
