                        The applicant by way of instant application U/S. 526 Cr.PC has sought for transfer of his case from the Court of learned 5^th Additional Sessions Judge, Shikarpur, to any other Court of competent jurisdiction for its disposal according to law mainly for the reason that said Court is lying vacant, which is not opposed by learned D.P.G for the State.

                        Heard arguments and perused the record.

                        Fair and early disposal of the case is right of applicant which could not be denied to him under the deception that learned trial Court is lying vacant. Consequently, the case of the applicant is withdrawn from the file of learned   5^th Additional Sessions Judge, Shikarpur and made over to the file of learned Sessions Judge, Shikarpur, to be disposed of by him or to be assigned to any other Court of competent jurisdiction for its disposal according to law.

                        The instant criminal transfer application is disposed of accordingly.
