It is the case of petitioner that his father Wali Muhammad was employee of WAPDA as Lineman, he died on 25.01.1982, therefore, they to be directed to appoint him under the deceased quota. As per the comments filed by the respondents, after death of Wali Muhammad, his wife entered into Nikkah with someone else and out of such wedlock, the petitioner took birth on 23.09.1983. It was 20 months after death of Wali Muhammad; he has managed the false testimonials claiming himself to be son of Wali Muhammad to get him appointed with them; his complaint has already been disposed of by the Federal Ombudsman; even otherwise, his brother Lal Dino has already been accommodated by them, soon after death of his father. The controversy with regard to actual parentage of the petitioner being factual could not be resolved by this Court in exercise of its constitutional jurisdiction; Lal Dino who happened to be son of late employee has already been accommodated by the respondents. Consequently, the instant petition being misconceived is dismissed which even otherwise is hit by laches.
