It is contended by learned counsel for the applicant that the applicant is lawful owner of the subject motorcycle which has been forfeited in favour of State by learned trial Court being unclaimed after disposal of the case wherein it was involved, ignoring his claim. By contending so, he sought for restoration of the subject motorcycle in favour of the applicant, which is not opposed by learned Addl.P.G for the State. Consequently, the property order is modified only to the extent that the applicant to be restored with possession of the subject motorcycle on furnishing security in sum of Rs.50,000/- and P.R bond in the like amount to the satisfaction of learned trial Court.

                        The instant Crl.Misc.Application is disposed of accordingly.
