4.         It is contended by learned counsel for the petitioner that the petitioner was employee of Agricultural Department, Sindh, was not being promoted to next upper grade despite it being due, therefore, a petition filed by him before this Court was disposed of on 23.02.2015 with direction to his Department to consider him for promotion in accordance with law; such direction was not complied with, therefore, he filed a contempt application; it was dismissed by this Court on 08.03.2023 with an advice to file a fresh petition as it was providing a fresh cause of action to him, as he has not been considered for promotion. On asking, it was stated by learned counsel for the petitioner that no proceeding for promotion of the petitioner has been conducted. If not then no fresh cause of action in favour of the petitioner has arisen to file the instant petition. When confronted with above, it was stated by learned counsel for the petitioner that he would not press the disposal of instant petition before this Court on merits, if the petitioner is permitted to file a fresh contempt application in his earlier petition for redressal of his grievance. Consequently, the instant petition is dismissed as not pressed. However, the petitioner may file a fresh contempt application in his earlier petition, if it is permitted by law.
