The applicant by way of instant Crl.Revision Application has impugned property order dated 14.12.2021, whereby his Truck has been confiscated in favour of the State by learned 1^st Additional Sessions Judge, Shahdadkot.

                        Heard arguments and perused the record.

                        Apparently, the confiscation of the Truck has been recorded by learned trial Court without providing chance of hearing to the applicant, which is contrary to the mandate contained by Article 10-A of the Constitution of Islamic Republic of Pakistan, 1973, which prescribes fair trial. Consequently, the impugned order only to the extent of confiscation of Truck is set aside with direction to learned trial Court to pass the same afresh after providing chance of hearing to all the concerned.

                        The instant Crl.Revision Application is disposed of accordingly.
