                        In this acquittal appeal the appellant has impugned the judgment dated 26-08-2009 passed by learned Civil Judge & Judicial Magistrate-I, Tando Allahyar in Criminal Case No.59 of 2008 arising out of crime No.142 of 2008 for offence punishable under section 489-F & 506(2) PPC.

                        Learned counsel for the appellant did not pin point any illegality in the impugned judgment but he merely stated that the judgment has been passed without taking into consideration the evidence adduced by the prosecution at the trial.

                        The scope of acquittal appeal is very limited and after acquittal the presumption of double innocence is attached and same finding can not be interfered without any justification or illegality. The appeal merits no consideration and same is dismissed in limini.
