It is alleged that the complainant party paid certain amount of money to the applicants and others for getting employment for their relatives; the appointment orders so issued were found fake, consequently, the applicants returned the money to the complainant party in shape of cheques dishonestly, those were bounced when were presented before the concerned Banks. On refusal of pre-arrest bail by learned XII-Additional Sessions Judge, Karachi West, the applicants have sought for the same from this Court by filing the instant bail application under section 498 Cr.P.C.

Heard arguments and perused the record.

The FIR of the incident is lodged with delay of about 10 days; the applicants are having nothing to do with the issuance of alleged cheques, those apparently have been issued by co-accused Mst. Samina Yasmeen. The offence alleged against the applicants is not falling within the prohibitory clause. The case has finally been challaned and there is no allegation of misusing the concession of interim pre-arrest bail on the part of the applicants. In these circumstances, the case for grant of pre-arrest bail to the applicants on the point of further inquiry and malafide is made out.

In view of above, the interim pre-arrest bail already granted to the applicants is confirmed on same terms and conditions.

Instant bail application is disposed of accordingly.
