3 & 4. It is contended by learned counsel for the petitioners that Notification of three elected members of Town/Municipal Committee, Mehar, having won the election has been withheld by Election Commission of Pakistan under deception of re-counting and now by way of Notification No.F.3(5)/2022 LGE S, Islamabad, the 16^th May, 2023, schedule for election for indirect seats in Metropolitan Corporation, Municipal Corporations, Town Municipal Corporations, Municipal Committees/Town Committees and District Councils relating to Sindh Province, has been issued by Election Commission of Pakistan, which has violated the fundamental rights of the petitioners being elected/aspiring candidates to contest such election, which is also against the mandate contained by Article 218 (3) of Constitution of Islamic Republic of Pakistan, 1973, which lay down that Election Commission of Pakistan has to make necessary arrangements to ensure that the election is conducted honestly, justly, fairly and in accordance with law. By contending so, he sought for suspension of operation of subject Notification for indirect election, so scheduled by the Election Commission of Pakistan, to the extent of Town/Municipal Committee, Mehar.

The point raised requires consideration. Repeat notice against the respondents and learned A.A.G/D.A.G for 07.06.2023. In the meanwhile, operation of subject notification issued by Election Commission of Pakistan for indirect election to the extent of Town/Municipal Committee, Mehar is suspended.
