                        A perusal of comments filed by Assistant Executive Engineer reflects that the private respondents No. 6 to 8 are not Khatedars and therefore, they had no right to construct any watercourse upon the land of petitioner.

                        Learned Addl. A.G. submits that the watercourse if any constructed by the private respondents is totally illegal, who have not effected appearance despite notices.  In the circumstances we dispose of this petition with the directions to the official respondents to dismantle watercourse and to take action against the private respondents in accordance with law and submit compliance report within ten days.
