                        The facts in brief necessary for disposal of instant petition are that an FIR was lodged by Naseer Ahmed with P.S Behram alleging therein abduction of his sister Mst.Naseeban at the hands of petitioner and others; its quashment is sought for by the petitioner by way of instant petition being one of the accused involved in above said incident. On being asked, it is stated by learned counsel for the petitioner that the cognizance of the case has already been taken by the Court having jurisdiction. After cognizance of the case, the quashment of FIR would not be justified. Consequently, the instant petition being misconceived is dismissed in limine together with listed applications, directing the petitioner to prove his innocence by joining the trial, if so is advised to him.
