                    The appellant/State has impugned judgment dated 01.06.2022, passed by learned 1^st Additional Sessions/Special Judge for CNS Cases/MCTC, Kandhkot, whereby he has acquitted the private respondent of the charge for being in possession of 5015 grams of Charas.

                    Obviously, acquittal of accused in terms of Sub Section (2A) to Section 417 Cr.PC is to be impugned by preferring an appeal by aggrieved person within 30 days. The instant criminal acquittal appeal is filed on 09.12.2022, it is much beyond the prescribed period of 30 days. No application for condonation of such delay is filed by the appellant/State. Consequently, the instant criminal acquittal appeal is dismissed in limine being time barred.
