Irshad Ali Shah, J; It is alleged that the applicant with rest of the culprits being members of BLA a banned organization was found carrying 11 hand grenades, 50 detonators and 15 safety fuse to be used for terrorist activities for that the present case was registered.

2.         The applicant, on having been refused bail by learned Special Judge, Anti-Terrorism Court, has sought for the same from this Court by way of instant Bail Application u/s 497 Cr.P.C R/W section 21-D of ATA, 1997.

3.         Heard arguments and perused the record.

4.         Surprisingly the name of the applicant is not appearing in the FIR, who it is said has been involved in this case falsely by the police on filing of an application u/s 491 Cr.P.C for his release from wrongful confinement, before Sessions Judge Shaheed Benazirabad by his relatives. Nothing has been brought on record, which may suggest that the applicant is associated with banned organization. Co-accused Rehmoo @ Rehmat Ali and 02 others have already been admitted to bail by this Court. The case has finally been challaned and there is no apprehension of tempering with the evidence on part of the applicant. In these circumstance; a case for release of the applicant on bail, on point of further inquiry obviously is made out.

5.         In view of above the applicant is admitted to bail subject to their furnishing solvent surety in sum of Rs.100,000/- (One lac) and P.R bond in the like amount to the satisfaction of learned trial Court.

6.         The instant Crl. Bail Application is disposed of accordingly.
