Zulfiqar Ali Sangi, J-. Perusal of the impugned order reflects that learned Ex-Officio/Justice of Peace has dismissed the application filed by application under Section 22-A and 22-B Cr.P.C, on the following reasons:
“The proposed accused Jai Ram Dass lodged F.I.R No.25/2022 under Section 489-F P.P.C at P.S A-Section Thull against the present applicant/ petitioner. The same proposed accused also lodged another F.I.R No.40/2022 under Section 489-F P.P.C at P.S City Jacobabad against the present petitioner. The DSP Complaint Cell and SHO P.S A-Section Thull submitted in their reports that the present petitioner committed fraud with several persons including the proposed accused and issued cheques in their favour, which have been dishonored. Out of these dishonored cheques, 08 F.I.Rs have been registered agaisnt the present applicant/ petitioner at different police stations of district Jacobabad. It seems that the in order to retaliate the F.I.Rs lodged by proposed against the present applicant/ petitioner, this application has been filed for lodging F.I.R against proposed accused for some malafide purpose. Therefore, no direction can be issued for lodging F.I.R. Accordingly, this application in hand stands dismissed.”
A careful perusal of the above reasoning, it appears that the impugned order has been passed after considering the entire material and no any illegality or infirmity appears to have been committed by learned Ex-Officio/Justice of Peace. Resultantly, instant criminal miscellaneous application being merit-less is hereby dismissed.
