Irshad Ali Shah, J;- It is alleged that the applicant with rest of the culprits in furtherance of their common intention, abducted Mst. Mehwish and Mst Pareena with intention to subject them to rape or to get them married with someone against their wishes, for that the present case was registered. The applicant on having been refused bail by learned Incharge IVth Additional Sessions Judge, Khairpur, has sought for the same from this Court by way of instant Bail Application u/s 497 Cr.P.C.

2.         Heard arguments and perused the record.

3.         The FIR of the incident has been lodged with the delay of about 02 days, such delay having not been explained plausibly, could not be over looked; the applicant, it is said, has nothing to do with the alleged incident, as alleged abductees have married of their own accord with Zamir Hussain and Ghulam Qadir after swearing their free will affidavits and have also put their appearance before another Bench of this Court at Hyderabad. The very case at one moment was recommended by the police to be cancelled under “C” class. The case has finally been challaned and there is no apprehension of tempering with the evidence on the part of the applicant. In these circumstance; a case for release of the applicant on bail, on point of further inquiry obviously is made out.

4.         In view of above the applicant is admitted to bail subject to his furnishing solvent surety in sum of Rs.100,000/- (One Lac)  and P.R bond in the like amount to the satisfaction of learned trial Court.

5.         The instant Crl. Bail Application is disposed of in above terms.
