Irshad Ali Shah, J;- It is alleged that on arrest from the applicant was secured unlicensed repeater gun of 12 bore with 04 live cartridges of same bore, which he allegedly was having to commit robbery, for that he was booked and reported upon. On having been refused bail by learned trial Court, they have sought for the same from this Court by way of instant Bail Application u/s 497 Cr.P.C.

2. Heard arguments and perused the record.

3. There is no independent witness to the incident; the offence alleged against the applicant is not falling within prohibitory clause; the case has finally been challaned and there is no apprehension of tempering with the evidence on the part of the applicant. In these circumstance; a case for release of the applicant on bail, on point of further inquiry obviously is made out.

4. In view of above the applicant is are admitted to bail subject to their furnishing solvent surety in sum of Rs.40,000/- and P.R bond in the like amount to the satisfaction of learned trial Court.

5. The instant Crl. Bail Application is disposed of in above terms.
