The applicant by way of instant Crl. Misc. Application has impugned the an order dated 27-06-2022, whereby learned IInd Additional Sessions/Ex-Officio Justice of Peace, Ghotki, has directed the police to record the statement of the private respondent u/s 154 Cr.P.C for purpose of FIR.

Heard arguments and perused the record.

Apparently, there is dispute between the parties over landed property and in order to resolve such dispute besides approaching their Nekmards the parties had been found involving each other in criminal cases, the occurrence of the alleged incident within jurisdiction of PS Khanpur Mahar was also denied by DSP Complaint Redressal Cell Ghotki by furnishing his report. In these circumstances, the impugned order could not be sustained, it is set aside. However, the private respondent may file a Direct Complaint of the incident in terms of section 200 Cr.P.C, if so is advised to him.

The instant Crl. Misc. Application is disposed of accordingly.
