4. The facts in brief for disposal of instant Acquittal Appeal are that a Direct Complaint was filed by the appellant for prosecution of the private respondents for allegedly committing offence punishable u/s 392 and 506/2 PPC, it was brought on record; the private respondents were directed to face the trial and on conclusion of trial they were acquitted by learned Judicial Magistrate, Daharki, vide judgment dated 31-12-2022, which is impugned by the appellant before this Court by way of instant Crl. Acquittal Appeal, without seeking leave to appeal which is necessary in terms of sub-section (2) to section 417 Cr.P.C. Even otherwise, no illegality, mis/non reading of evidence is pointed, which may justify this Court to make interference with the impugned judgment, consequently, the instant Crl. Acquittal Appeal being misconceived is dismissed in limini.
