            Applicant/complainant seeks transfer of criminal case bearing Crime No.122 of 2021 registered at Police Station Foujdari, District Shikarpur for offence under section 429 PPC pending before learned 1st. Civil Judge and Judicial Magistrate, Shikarpur to some other court. Previously transfer application has been dismissed by learned Sessions Judge, Shikarpur vide order dated 18.8.2020.

            Today, applicant/complainant has been heard at length. He submits that he has lost confidence over Civil Judge and Judicial Magistrate-1, Shikarpur and questioned the conduct of Presiding Officer. Allegations are not substantiated. Mere allegation is not sufficient to withdraw the case from the competent court of law. Accordingly, the transfer application being without substance is dismissed in limine however; learned trial court is directed to decide the case of applicant/complainant expeditiously, in accordance with law.
