            Through this transfer application, applicant/complainant Karamullah, seeks transfer of Criminal Case No. 03 of 2022. (Re: State V. Shah Dost and others) bearing crime No.109/2021 registered at police station Karampur for offences under sections 337-A(ii), (i), F(i), H(2), 147, 148, 149 and 504 PPC, pending before learned Civil Judge & Judicial Magistrate, Tangwani, to the court of Additional Sessions Judge-1, Kandhkot, on the ground that counter cases may be tried together. Notice of this application was issued to the respondents/accused as well as Additional Prosecutor General.

 

            Mr. Safdar Ali G. Bhutto, advocate for respondents No.1 to 6 as well as Additional Prosecutor General submitted that Crime No.109/2021 registered at Police Station Karampur under section 337-A(ii),(i),F(i),H(2),147,148, 149 and 504 PPC, is counter case of Crime No.111/2021 registered at Police Station Karampur for offence under section 324 PPC pending before learned Additional Sessions Judge-1, Kandhkot.

 

            By consent and in order to avoid conflict of the Judgment, the case bearing crime No.109/2021 of Police Station Karampur, is withdrawn from the file of learned Civil Judge and Judicial Magistrate, Tangwani and transferred to the court of Additional Sessions Judge-1, Kandhkot for trial.

 

            Transfer application is allowed in the above terms.
