            Through this transfer application, applicant/accused Babal seeks transfer of Special Case No. 166 of 2022. (Re: State V. Babal Brohi) bearing crime No.09/2022 registered at police station Raheemabad for offence under section 9(C) Control of Narcotics Substance Act, 1997, pending before the learned 1st. Additional Sessions Judge, Shikarpur.

            Notice of this application was issued to APG and report was called from learned Sessions Judge, Shikarpur. It is reported by learned Sessions Judge, Shikapur vide his letter dated 13.09.2022 that court of 1st. Additional Sessions Judge, Shikarpur is lying vacant since 18.5.2022. It is observed that expeditious disposal of the case is right of the accused. Since court is lying vacant since 18.5.2022, therefore, Special Case No. 166 of 2022. (Re: State V. Babal Brohi) is withdrawn from the file of 1st. Additional Sessions Judge, Shikarpur and it is made over to learned Sessions Judge, Shikarpur with directions to either try the case himself or transfer the same to other Additional Sessions Judge, having jurisdiction to try cases under the provision of Control of Narcotics Substance Act, 1997.

            Transfer application is accordingly disposed of.
